Question:
I have a client who owns a chain of retail stores. One director has recently moved to a new house and would like to file a form T1 to use the company registered office as their home address. Is there a format for the supporting statement to be signed by a member of the Garda Siochana to support the form T1? Can the B10 be filed online and is a paper T1 sent to the CRO?
Answer:
Unfortunately its not very clear the process to complete a T1 specially with the Gardai. I have broken down the steps below.
When sending to CRO please include a Cover Page which is;
Addressed ‘For the Attention of the Registrar’
Includes the submission number (SR Number) of the B10 (or A1 if doing this on incorporation) aswell as a copy of the B10 details page.
I would recommend emailing B10 department just to flag a Form T1 is also being submitted to prevent the B10 being wrongly returned,
When filing the B10 on the second page there is a box to tick ‘The Director wishes to use the registered office address on the public record instead of their residential address’ please ensure you are ticking this
Statement form Garda, who rank is not below Chief Superintendent under S.150(11) CA2014
The hard copy statement usually contains the following;
request that the usual residential address of a person who is an officer of the company shall not appear on the register kept by the Registrar for reasons of personal safety or security.
There is no template as such however most Stations will be familiar with the process and can assist;
I would recommend calling ahead to see what the Station to see what they require as there is often no formal process on what a Director must produce to as ‘evidence’ to make the application to form the statement and if they must be present at the station to do so.
As I’m sure you are aware the Director must make it clear they are requesting this for reasons of personal safety or security and they must be supplied to the Gardai.
Append Form T1
Post all items addressed ‘For the Attention of the Registrar’ to The Companies Registration Office, Bloom House, Gloucester Place Lower, Dublin 1.
If the Registrar is fully satisfied that the officer of the company has fully completed the procedure, the officer will be notified and the exemption is from date the Form T1 is registered.
