Does a director who resides in Northern Ireland qualify as being an EEA resident director for the purpose of meeting the requirements of Section 137 of the Companies Act 2014?
Answer:
As the UK left the EEA on 1 January 2021, any Irish company with a non eea resident as a director will be required to have a Section 137 bond in place from that date. This includes Northern Ireland currently. Alternatively an EEA Director could be appointed or the ‘Real and Continuous link’ with Revenue may be established.
